Terms and Conditions

These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with the Deeper Waters mobile application (the “Service”) operated by Fresh Wind Technologies LLC (“us”, “we”, or “our”).

Please read these Terms and Conditions carefully before using our Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 13 years old to use the Service.

2. User Content and Conduct

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material (“Content”). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service for the purpose of operating and providing the Service to you and your connections. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

As a Christian faith-based community, we are committed to maintaining a safe and respectful environment. You agree that you will not post any Content that:

• Is illegal, threatening, defamatory, or invasive of privacy.
• Constitutes harassment, bullying, or hate speech.
• Contains nudity or is sexually explicit or pornographic.
• Promotes spam, scams, or commercial solicitation.
• Infringes on any party's intellectual property, including copyright, trademark, or patent.
• Impersonates any person or entity.

We reserve the right, but not the obligation, to monitor and review all Content submitted to the Service and to remove any Content that we determine, in our sole discretion, violates these Terms or our community standards.

3. Premium Subscriptions

Some parts of the Service are billed on a monthly subscription basis (“Subscription(s)”). If you choose to purchase a Subscription, payment will be charged to your Apple App Store or Google Play Store account, and you will be subject to their terms and policies.

Subscription Details

• Subscription Title: Deeper Waters Premium
• Subscription Length: Monthly (auto-renewable)
• Price: $4.99 USD per month (prices may vary by region)
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment: Payment will be charged to your App Store or Google Play account
• Cancellation: You can manage subscriptions and turn off auto-renewal in your account settings

Subscriptions will automatically renew each month unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period.

You may manage your Subscriptions and turn off auto-renewal by going to your Account Settings in the respective app store after purchase. All purchases are final and non-refundable, except as required by applicable law or the policies of the app store provider.

End User License Agreement (EULA): By downloading, installing, or using the Deeper Waters app, you agree to be bound by these Terms and Conditions, which serve as the End User License Agreement for this application. If you do not agree to these terms, do not download, install, or use the application.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Fresh Wind Technologies LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the account deletion feature within the app.

6. Limitation Of Liability

In no event shall Fresh Wind Technologies LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
